Terms of Use
Welcome to Foamies. By creating an account, you accept these terms. Take the time to read them, they say what you can expect from us, and what we expect from you.
1. Who offers Foamies
Foamies is offered by Lorène Bergougnoux and Théa Bailly, its founders. Contact: foamiesclub@gmail.com.
Foamies is a social app for surfers: finding surfers nearby, building a circle of friends (the "Club"), and tracking your surf sessions and those of your Club.
2. Who can use Foamies
- You must be at least 18.
- You provide accurate information at sign-up, including your date of birth.
- You are responsible for keeping your password confidential and for everything that happens on your account.
- One account per person.
3. Your content
What you post, photos, sessions, comments, messages, spots, remains yours. You simply grant us the right to display it within the app, in order to run it (for example showing your session to your Club). We claim no ownership of your content and do not use it outside this scope.
You are responsible for what you post. By posting, you confirm that you have the right to, in particular that you have the consent of the people who appear in your photos or whom you mention.
4. Community rules
Foamies is built on respect. The following are prohibited:
- harassment, threats, intimidation;
- hateful or discriminatory speech;
- unsolicited sexual content or sexual exploitation;
- impersonation;
- spam, scams, unauthorized advertising;
- posting content about other people without their consent;
- any illegal activity.
You can report content or a user (the "…" menu), and block someone at any time. We review reports and may remove content, suspend or delete an account that breaks these rules, without notice where the seriousness justifies it.
5. Meeting other surfers, your safety
Foamies helps you connect with other surfers nearby. But we do not verify users' identities, and any meeting outside the app is entirely at your own risk.
Stay cautious: meet people in public places, tell someone close to you where you are going, and trust your instinct. Foamies cannot be held responsible for interactions, behaviour or harm occurring outside the app.
6. What we owe you, and our limits
Foamies is provided "as is", and is currently in beta: features may change, be unavailable or contain errors. We do our best for a reliable service, but we do not guarantee it will be uninterrupted or flawless.
Information shown via third-party services (weather, sea conditions, maps, places) is provided for guidance and may be inaccurate, do not base a safety decision at sea on it alone.
To the extent permitted by French law, we cannot be held liable for indirect damages arising from the use of Foamies. Nothing in these terms limits liability that cannot legally be limited.
7. Your personal data
The processing of your personal data is described in our Privacy Policy, which forms an integral part of these terms.
8. Ending your use
- You can delete your account at any time (Settings → Delete my account). Deletion is immediate and permanent.
- We may suspend or delete an account that breaks these terms, or if we have to stop operating the service.
9. Ownership
The name "Foamies", its logo and its visual identity belong to its founders. You may not reproduce them without authorization.
10. Changes
We may update these terms. In the event of a significant change, we will inform you in the app. The version you accepted is recorded with your sign-up.
11. Governing law
These terms are governed by French law. In the event of a dispute, we will first seek an amicable solution; failing that, the French courts will have jurisdiction.
